Robert WINTER

This is the last Will and Testament of me, Robert Winter of Bedford Row in the County of Middlesex, Gentleman. I appoint my son William Esdaile Winter my sole Executor and I direct him to pay my debts and funeral expenses. I give and bequeath to my dear wife Sarah Harkson Winter for her absolute use and benefit all my plate, linen, china, diamond ring and other trinkets, dressing case and its contents, watch chains, seals, clocks, crockery, wearing apparel, books, drawings, prints and all other articles of a personal nature wherever they may be situate at the time of my decease. I also give and bequeath to my said dear wife for her life an annuity of two hundred pounds clear of all deductions whatsoever to be paid quarterly on the usual quarter days the first payment to be made on such of the said quarter days as shall first happen after my death and as to the residue of my Estate and Effects ~I give and bequeath the same unto my five dear children viz William Esdaile, Mary, Rebecca, Emma and Adelaide and to my dear son in law the Revd Thomas William Davids in six equal shares as tenants in common. I declare that it shall be lawful for my Executor to become the purchaser of any part or parts of my estate and effects at any such sale or sales thereof or privately but that in the latter case he shall not become the purchaser at a less price than in the opinion of a well known and eminent Auctioneer shall be the value of such part of the said estate and effects as shall be so purchased and I authorise and empower my Executor to pay any debts owing or claimed to be owing by or from me or my estate and any liabilities to which I or my estate may be subject or may be allowed to be subject upon any evidence which he shall think sufficient and to attempt any composition or any security real or personal for any debt or debts owing to me or my estate and to allow such time for the payment of any such debt or composition for a debt either with or without taking security for the same as to my said Executor shall seem reasonable and also to compromise or compound or subject to Arbitration and adjust and settle all debts accounts matters and things which shall at the time of my death be owing or claimed to be owing from or to me or my estate or be depending or arise between me or my Executor and any other person or persons and for any of the purposes aforesaid to enter into, give, sign, make do and execute such deeds or instruments of composition, Releases, Bonds or instruments of submission to Arbitration and other instruments, acts, deeds, matters and things as they or he shall think expedient and to observe, abide by and perform or to contest or dispute any instrument or transaction which may have been made or entered into as aforesaid or any award or awards to be made in pursuance of any such submission to Arbitration as aforesaid and generally to act in relation to the promises in such manner as he shall in his uncontrolled discretion think expedient without being liable for any loss which may be occasioned thereby. I give devise and bequeath all the estates which at the time of my decease shall be vested in me upon any trusts or by way of mortgage and of which I have power to dispose by this my Will with their rights, members and appurtenances unto the said William Esdaile Winter his heirs executors administrators and assigns respectively according to the nature and quality thereof respectively upon the trusts and subject to the equity of redemption which at the time of my decease shall be subsisting or capable of taking effect therein respectively but the money secured on such mortgages to be considered and taken as part of my personal estate In witness whereof I have at the foot of this my Will signed my name this twenty third day of March one thousand eight hundred and fifty five Robt. This is a Codicil to the last Will of me Robert Winter of Bedford Row. I hereby appoint my dear brother Thomas Bradbury Winter and my dear son in law Thomas William Davids to be executors of my said will conjointly with my dear son William Esdaile Winter whom by my said Will I have appointed sole Executor thereof. As witness my hand this second day of July 1855 Robt. Proved at London with a Codicil 19th October 1855 before the Worshipful William Calverley Curtis Doctor of Laws and Surrogate by the Oath of William Esdaile Winter Esquire the son of the deceased the executor named in the will and Thomas Bradbury Winter Esquire the brother of the said deceased and the Reverend Thomas William Davids the executors named in the said Codicil to whom Admon was granted having been first sworn duly to Administer.
